Terms of the order
Version 2.0 of 5 November 2026
1. Provider and scope
The provider and contracting party is Cloudkasten GmbH, Seestr. 20 G, 50374 Erftstadt, Germany, Amtsgericht Köln (Cologne local court), HRB 92697, represented by its managing director Alexander Hagemann. You will find the ways to contact us in the imprint of this website.
The offer is directed exclusively at companies, self-employed persons and freelancers who place the order for their commercial or professional activity. Consumers cannot place an order through this website.
These terms apply in the version stated at the time of your order. Deviating terms and conditions only become part of the contract if expressly agreed.
2. Subject matter and scope
We carry out technical investigations, document publicly accessible content and submit fact-based abuse reports for the shops expressly ordered.
Our services comprise:
- 1.technical capture of the pages named, as far as they can be retrieved, in particular screenshots, retrieved source code, URLs, retrieval times, retrieval status and SHA-256 checksums;
- 2.investigation of publicly available infrastructure information, in particular on the domain, registrar, hosting and upstream services;
- 3.compilation of our own observations and of your details and documents;
- 4.submission of individually approved abuse reports through suitable reporting channels;
- 5.documentation of replies, reminders on the matter and suitable further reports;
- 6.regular checks of the reported content during the review period;
- 7.weekly status reports and a final report.
We distinguish between our own findings, your details and unresolved indications. Our check before sending concerns the factual basis, completeness and suitability of the reporting channel.
We do not carry out any individual legal assessment. In particular, we do not decide whether a specific use infringes trade mark, copyright, competition or domain rights.
The use of a brand, of product images, of company details or of a former domain does not in itself constitute a sufficient indication of abuse. We only take on matters that can be handled within the scope of our services on the basis of specific facts.
Not included are individual legal advice, legal letters of claim, cease-and-desist letters (Abmahnungen), legal demands against operators or infrastructure providers, settlement negotiations, representation in court, UDRP/URS proceedings and domain transfers.
If an individual legal review becomes necessary, we suspend the report concerned and inform you. Without a separate agreement, we do not instruct a lawyer on your behalf.
An escalation to ICANN Compliance only takes place if a specifically identified concern falls within the relevant contractual area of responsibility. This does not involve any general decision on disputes about trade mark rights or about the lawfulness of a shop.
3. Decisions of the providers and limits of the documentation
The providers we contact decide on their own responsibility whether and which measures they take. We guarantee neither a measure nor a particular time nor a permanent shutdown.
Our captures document the results of our technical retrievals under the conditions recorded in each case. Restrictions and failed retrievals are marked as such.
Checksums allow a later comparison of files. On their own, they prove neither the time of capture nor the authenticity or completeness of the captured content. Unless expressly agreed separately, we do not use any independent or qualified time stamping and do not promise any particular evidential value in court.
4. Order, acceptance and start
By submitting the order form, you make a binding offer to conclude the contract described. The contract is concluded by our express order confirmation by email.
Technical capture may begin as soon as your order is received. This does not give rise to a separate claim for payment if the order is not accepted.
We check whether the matter can be handled within the scope of our services on the basis of the available facts. If we do not accept the order, we refund any amounts already paid in full within seven calendar days.
We only send reports after acceptance, receipt of payment and documented individual approval. If necessary details are missing, we will let you know.
We write to you in German, and in English for orders placed through the pages in other languages, unless agreed otherwise.
5. Authorisation and cooperation
You authorise us to submit the agreed reports on the matter on behalf of your company and to answer factual queries. This authorisation does not include legal representation or the enforcement of claims.
You confirm that:
- you are authorised to place the order for the company named;
- your details are correct and complete to the best of your knowledge;
- you may provide the documents for the agreed purposes;
- you disclose known reseller, partner and other business relationships with the reported shop.
Please inform us without delay of changes, errors or new findings, and answer specific queries that are necessary.
We only submit the details and documents required for the report concerned. If a recipient requires special proof of authorisation, we obtain it from you. We do not guarantee that the recipient will accept our report.
Your confirmation does not replace our check of the factual basis. We clarify apparent contradictions before sending.
6. Price, review period and refund
Price and payment. The price is €800 net per expressly ordered shop plus statutory VAT. For offers in other languages, the price shown at the time of the order applies. The tax treatment and the total price are shown before the order. You pay in advance through Stripe and receive an invoice.
Which addresses are charged together as one shop or as separate shops is shown before you place your order with an obligation to pay.
Start and duration. The review period for each shop is 30 days from the first documented sending of an abuse report for that shop. We will inform you of this time and of the end.
If we do not send a first report within five working days of the acceptance of the order, receipt of full payment and receipt of the required documents, we refund the price for the shop concerned within a further seven calendar days. A different start deadline requires your express consent. Working days are Monday to Friday, excluding public holidays in North Rhine-Westphalia. We name required missing documents specifically.
Confirmed result. There is a result when the documented objectionable activity is no longer publicly accessible at the ordered addresses and is not continued through a redirect from there either.
This must be confirmed by two separate checks at least 24 hours apart within the last 72 hours of the review period. Where several addresses were ordered together, the conditions must be met for all addresses.
A neutral parking or suspension page can meet the condition. A redirect only meets it if its target and any further redirects do not continue the objectionable activity or lead to it.
A single failed retrieval, a block against our checking systems, an unclear technical error or a mere search engine or browser warning does not count as a confirmed result. We re-check unclear or contradictory findings; if they remain unresolved, we treat the result as not confirmed.
We do not thereby claim that our report caused the change or that the shop has disappeared permanently.
Refund. If there is no confirmed result at the end of the review period, we refund the price paid for the shop concerned, including VAT, within seven calendar days to the original means of payment.
A shop that had temporarily disappeared does not meet the condition if the objectionable activity is accessible again at the end of the review period. Missing check data, internal processing errors or a necessary legal clarification do not exclude your refund.
The refund is excluded only insofar as you expressly stop the action early, or a material incorrect statement or necessary cooperation omitted despite a specific request was demonstrably the reason why we could not carry out the order. General exclusions of liability do not replace this proof.
Activities that newly arise after the end of the review period are not covered by this refund rule. Statutory claims remain unaffected. We refund in the currency of payment; we do not compensate for external changes in exchange rates.
7. Further finds
We first report further suspicious shops to you as indications. They are only added to the order with your express consent and with the additional price stated.
Each additionally ordered shop has its own start of sending, its own review period of 30 days and the same refund rule.
We take redirects of the originally ordered shop into account when checking its result. Without a separate order, they do not give rise to an additional price.
8. Stop and end
You can instruct us at any time to stop further reports. We confirm the stop and explain its consequences for the order concerned.
Monitoring ends for each shop when its 30-day review period expires or upon an early stop expressly requested by you. We then prepare the final report.
A suspension initiated by us because facts are missing or require legal clarification does not count as a stop requested by you.
We may end an order for good cause, in particular if it cannot be handled within the scope of our services. The refund claims under section 6 remain. Statutory rights of termination of both parties remain unaffected.
9. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and insofar as we have given a guarantee.
In the case of slight negligence, we are only liable for the breach of an essential contractual obligation. This is an obligation whose fulfilment makes the performance of the contract possible in the first place and on whose observance you may regularly rely. In this case, liability is limited to the damage that was foreseeable when the contract was concluded and is typical for such an order.
We accept no responsibility for independent decisions and actions of the providers we contact and of shop operators. Our own contractual obligations and the refund rule remain unaffected.
These liability rules also apply in favour of our employees and vicarious agents.
10. Confidentiality, documentation and reports
We treat your details and documents confidentially and only pass them on to the agreed extent required or on the basis of a legal obligation. We only name your company as a reference with your consent.
You may use our documentation and reports for your own purposes, including passing them on to your legal advisers, authorities or courts. We promise neither a particular legal effect nor a particular usability in court.
We mark the limits of our technical capture and unresolved findings in the report.
11. Data protection and retention
Our privacy notice explains the purposes, legal bases, recipients, transfers and your rights.
If no contract is concluded, we generally delete your details, documents and captured pages no later than six months after our last message. We generally keep the records of completed orders for three years. Statutory retention obligations and a longer storage that is necessary and justified in an individual case remain unaffected. Details are set out in the privacy notice.
12. Versions and changes
Your order is governed by the terms in the version stated at the time of your order. Later changes only apply to new orders, unless we expressly agree otherwise with you.
13. Law, place of jurisdiction and language
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory statutory provisions remain unaffected.
Insofar as an agreement on the place of jurisdiction is legally permissible, in particular towards merchants, legal entities under public law or special funds under public law, the registered office of Cloudkasten GmbH is agreed as the place of jurisdiction.
For contracts concluded through the German website, the German version is authoritative. For offers in other languages, the language rules and the binding contract version must be expressly stated at the time of the order: for orders through the non-German pages of this website, this English version is binding, and translations into other languages are for information only. This version does not replace a separate review of sales in other countries.
Should a provision be invalid, the rest of the contract remains valid; the invalid provision is replaced by the statutory provisions.
Orders placed before this version took effect remain governed by the version stated at the time of the order. This version as a text file
